Nobel Canadian Contest Official Rules & Regulations
NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
Apple does not sponsor and is not involved in this promotion or any other Nobel promotion.
1. Contest period: No purchase necessary to enter or win
Making a purchase for Entry will not increase a single Entry's odds of winning. The Dreamable Environmental contest is held by DREAMABLE INC. (the “Contest Organizer” or “Sponsor”) .
The contest (the “Contest”) begins at 3:59:00 p.m. ET on March 19, 2021 and ends at 3:59:59 p.m. ET on March 26, 2021 (the “Contest Period”).
Open to Canadian residents ex Quebec who have reached the age of majority in their province or territory of residence by the date they enter the Contest. Employees, agents and representatives of the Contest Organizer or of its subsidiaries, their advertising and promotional agencies or suppliers of prizes, products, services and material related to this contest, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and any individuals with whom such employees, agents and representatives are domiciled, are not eligible.
3. How to enter and win
NO PURCHASE NECESSARY. Internet access contest registration required. You understand that you are providing your information to the Contest Organizer or its agents. The information you provide will only be used as noted in the disclosure statement.
During the Contest Period enter through the contest application on the Nobel website, www.nobel.app and claim and submit your entry by filling out the registration form and creating an account. If you have entered the contest previously some fields may be populated for you. All fields must be completed unless indicated as optional. Duplication, or any attempts to exceed the maximum number of Accounts per person is a violation of these Official Contest Rules and may result in disqualification.
Limit of ten (10) free entries per person per week. Each free entry must be submitted separately. Use of automated devices is prohibited; automated entries (including but not limited to entries submitted using any robotic, script, macro, or other automated service) are not permitted and may result in disqualification.
Additional Entries: Each visitor to the mobile application may, at their option, subscribe for Environmental Benefits. This is a monthly subscription where each dollar of the subscription goes towards offsetting the subscriber’s environmental footprint by creating beneficial environmental impacts. In every month in which the visitor subscribes, every subscription dollar gives them an additional entry into that month’s contest. The minimum subscription is $5 which provides the subscriber with five (5) entries for every weekly contest additional Entries.
4. How to win
A. Grand Prize Sweepstakes: On March 26, 2021, at 3:59:59 PM ET, a random draw will be conducted from all eligible entries received during the Contest Period.If you are selected as eligible to win the Grand Prize, you may use the form provided on the link of your ticket to contact us or you will be contacted by email by the contest judging organization within approximately fifteen (15) business days of the draw at the email address you provided when you registered. See prize claim conditions in Paragraph B below.
B. Prize Claims & Conditions: Before being declared the winner of the prize, the selected entrant must first correctly answer, without assistance of any kind, whether mechanical, electronic or otherwise, a time-limited mathematical skill-testing question to be administered at a mutually convenient time by telephone. If the potential Prize winner fails to correctly answer the Skill Testing Question, provide the Sponsor with their full contact information, sign and return the Prize release or cannot accept the Prize as awarded for any reason, or otherwise violates these Official Rules (as determined by the Sponsor in its sole and absolute discretion), they will be disqualified and will forfeit all rights to the Prize. A new Entry is then randomly selected again.
The selected entrant will also be required to complete and return to Sponsor (or its authorized agent) by the deadline specified in the documents a written declaration and release (the “Declaration and Release”), declaring that the entrant is eligible to win the prize in accordance with these Official Contest Rules and releasing Sponsor, and all of its respective directors, officers, owners, partners, shareholders, employees, agents, representatives, successors and assigns from any liability in connection with this Contest, or the use, misuse or possession of any prize. Prizes will only be awarded to verified winners. Allow 2-3 weeks delivery for the prize after the return of a completed Declaration and Release.
Return of any prize or prize notification as undeliverable, inability to reach the selected entrant, failure of selected entrant to respond to notification within two (2) business days of first attempt by the contest judging organization, failure of selected entrant to provide any required proof of eligibility, the completed Declaration and Release, or other required documentation within five (5) days, failure to correctly answer the skill-testing question, or other non-compliance with these Official Contest Rules may result in disqualification, forfeiture of the prize and, at Sponsor’s sole discretion, selection of an alternate eligible entrant who will be subject to disqualification in the same manner.
The Grand Prize is a cheque for $60. A prize forfeited may, at Sponsor’s option, be awarded to an alternate entrant. PRIZES MUST BE ACCEPTED AS AWARDED.
C. Prize Conditions: Prizes must be accepted as awarded; however, Sponsor reserves the right to substitute a prize of equal or greater value at its sole discretion, if a prize cannot be awarded as described herein for any reason.
D. Personal Information: Sponsor and its authorized agents will only use and disclose the personal information you provide when you register and enter the Contest for the purposes of administering the Contest and prize fulfillment, unless you otherwise agree. By accepting a prize, winner agrees to Sponsor's use of his/her name, city/province of residence, biographical information, statements, voice and likeness in any advertising and publicity Sponsor may conduct relating to the Contest in any media or format, whether now known or hereafter developed, including but not limited to the World Wide Web, at any time or times in perpetuity, without further compensation or notice. Aggregate and/or anonymized Contest winner information from this and any other contests that may be offered by the Sponsor may be used by the Sponsor to communicate about the Contest.
6. Right to Void/Terminate/Suspend/Modify
Any materials used in this Contest which have been tampered with, mutilated, altered, forged, reproduced, not legitimately obtained, are illegible or which contain or reflect computer, software, printing, production or other errors will be void. Sponsor reserves the right, to terminate, suspend or modify this Contest, in whole or in part, at any time and without notice or obligation if, in Sponsor's sole opinion, any factor interferes with its proper conduct as contemplated by these Official Contest Rules. Without limiting the generality of the foregoing, if the Contest, or any part thereof, is not capable of running as planned for any reason, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, printing errors, programming errors, seeding errors, technical failures, or any causes beyond the reasonable control of Sponsor, which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor may, in its sole discretion, void any suspect entries and: (a) terminate the Contest, or any portion thereof; (b) modify or suspend the Contest, or any portion thereof, to address the impairment and then resume the Contest, or relevant portion, in a manner that best conforms to the spirit of these Official Contest Rules; and/or (c) award the prizes from among the eligible, non-suspect entries received up to the time of the impairment in accordance with the winner selection criteria discussed above. No more than the above-stated number of prizes will be awarded. Should any error of any kind, whether technological, printing, production, human or otherwise, or any other event result in more prizes being claimed than the number stated above, the prizes not yet awarded may be awarded in a random drawing from amongst all eligible claimants who have not yet received a prize. In any such drawing, the selected entrants must correctly answer, without assistance of any kind, whether mechanical, electronic or otherwise, a mathematical time-limited skill-testing question to be administered by telephone, email or mail, and execute any documents as may be required before being declared a winner.
7. General Conditions & Rules
i. Winning a prize is contingent on fulfilling all the requirements set forth herein. All entries become the property of Sponsor and will not be returned or acknowledged. Mass entries, automated entries, entries submitted by third parties, and any entries or prize claims that are late, incomplete, fraudulent, illegible, unidentified or delayed will be void. All entries and prize claims are subject to verification. Proof of entry submission does not constitute proof of receipt. By entering this Contest, entrants agree to abide by these Official Contest Rules. Decisions of Sponsor and/or the contest judging organization will be final and binding on all matters pertaining to this Contest. Contest is subject to all applicable federal, provincial and municipal laws. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process, the operation of the Contest and/or Contest Website, violates the Official Contest Rules, or acts with intent to annoy, abuse, threaten or harass any other person. WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of the person who submitted an entry, the authorized account holder of the e-mail address submitted at registration will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an access provider, service provider, or other person or organization responsible for assigning e-mail addresses for the account associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.
ii. All “Winning” users eligible for a Prize must have their accounts individually inspected and confirmed to be completely legible. Liability for irregular, illegible or blank Entry history is limited to replacement with another Entry. If, due to any other type of error, there are more Prize claims than Prizes available Contest Sponsor reserves the right to award any remaining Prizes through a random draw from among all eligible Prize claims. It is extremely rare to receive an irregular, illegible or blank account history or Entry, but if this should occur, the irregular, illegible or blank Entry will be replaced with new entry.
iii. Employees, representatives or agents of, or those domiciled with an employee, representative or agent of, Nobel or Dreamable Inc, and their parent, affiliated and related companies, Nobel or Dreamable Inc. franchisees/licensees, the consulting, advertising and promotion agencies of the Contest Sponsor, the independent contest organization, and any other suppliers, and distributors are not eligible to participate nor win a Prize in this Contest. Employees, representatives or agents of the consulting, advertising and promotion agencies of the Contest Sponsor and the independent contest organization as described in this paragraph are limited to those employees, representatives or agents who are providing services in any way to Nobel Dreamable Inc. The Contest is not open and void where prohibited by law. Users play at their own risk and discretion.
iv. Any participating in this Contest, each Entrant agrees to be bound by these official rules and all decisions of the Contest Sponsor and the independent contest organization, which are final. Without limitation, Contest Sponsor reserves the right to administer an alternate Skill Testing Question as it deems appropriate to address discrimination or disability issues.
v. By submitting an Entry to the Contest as described above, the Entrant (the person who submitted the Entry) agrees to communicate with the Sponsor electronically and agrees that the act of submitting the Entry to the Contest is a binding form of your electronic signature, which you agree binds you to these Official Rules.
vi. In the event of a dispute regarding who submitted an Entry, Entries will be deemed to have been submitted by the authorized account holder (the registered and historical User of the account) of the account used to submit the applicable Entry as accordance of the history and information of the account. An Entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that they are the authorized account holder used to submit the applicable Entry and, if applicable, that they have all necessary consents, permissions and/or licenses as required by these Official Rules.
vii. The Sponsor reserves the right and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Official Rules, to the extent necessary, for purposes of verifying compliance by any Entrant or Entries with these Official Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Official Rules, or for any other reason.
8. Limitation of Liability and Releases
BY PARTICIPATING IN THIS CONTEST, ENTRANTS AGREE THAT SPONSOR, THE CONTEST JUDGING ORGANIZATION, THEIR RESPECTIVE PARENT, RELATED AND AFFILIATED COMPANIES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY, THE "RELEASEES") HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM: A) A PRIZE, INCLUDING THE ACCEPTANCE, PARTICIPATION IN, MISUSE OR USE OF THE PRIZE AND ANY TRAVEL RELATED THERETO; B) ENTRY OR PARTICIPATION IN THIS CONTEST, INCLUDING ACCESS TO AND USE OF THE CONTEST WEBSITE, OR C) ANY CLAIMS BASED ON PERSONALITY OR PRIVACY RIGHTS, DEFAMATION OR MERCHANDISE DELIVERY.
Without limiting the foregoing, the Releasees, and any of Sponsor's other agencies, suppliers or contractors, shall not be responsible for: (a) any incomplete or inaccurate information that is caused by Contest Website users, or by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of submissions in the Contest; (b) lost, interrupted, or unavailable network, server, service provider, on-line systems, telephone networks or telephone lines, or any other connections; (c) the theft, destruction, loss or unauthorized access to, or alteration of, entries; (d) any problems with, or malfunctions or failures of, telephone networks or lines, computers or computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (e) garbled transmissions or miscommunications; (f) failure of any e-mail to be received by or from the contest judging organization or Sponsor for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (g) damage to a user's computer equipment (software or hardware) occasioned by participation or downloading of materials related to this Contest; (h) printing, distribution, programming or production errors, and any other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise; or (i) technical, pictorial, typographical or editorial errors or omissions contained herein.
9. Consent & Governing Law
i. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all Entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entrants and/or Entries. Users play at their own risk and discretion.
iii. To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants, Sponsor or any of the other the Releases in connection with the Contest will be governed by and construed in accordance with the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. The parties hereby consent to exclusive jurisdiction and venue of the courts located in Alberta in any action to enforce (or otherwise relating to) these Official Rules or relating to this Contest.
